الفَيْء: يُطلق على ما يحلُّ أخذ أموال الكُفَّار قاله البرجندي وفي "المُغرب" ما نِيْلَ من أهل الشرك بعد ما تضع الحرب أوزارها وتصير الدارُ دار الإسلام، وفي فتح القدير: "الفيء: هو المال المأخوذ من الكفار بغير قتال، كالخراج والجزية، أما المأخوذ بقتال فيسمى غنيمة"، وفي كشاف المصطلحات: "هو ما يوضع في بيت مال المسلمين". قال النسفيُ: "الفيء: ما ردَّه الله تعالى على أهل دينه من أموال مَن خالفهم في الدين بلا قتال، إما بالجلاء أو بالمصالحة على جزية أو غيرها، والغنيمةُ أخصُّ منه والنفل أخصُّ منها".
