(و ص ف) : (بَيْعُ الْمُوَاصَفَةِ) أَنْ يَبِيعَ الشَّيْءَ بِالصِّفَةِ مِنْ غَيْرِ رُؤْيَةٍ وَقِيلَ أَنْ يَبِيعَهُ بِصِفَتِهِ وَلَيْسَ عِنْدَهُ ثُمَّ يَبْتَاعَهُ وَيَدْفَعَهُ (وَفِي الْمُنْتَقَى) كَانَ أَبُو حَنِيفَةَ - رَحِمَهُ اللَّهُ - يَكْرَهُ الْمُوَاصَفَةَ وَهِيَ أَنْ لَا يَكُونَ عِنْدَ الْبَائِعِ شَيْءٌ وَفِي الْإِيضَاحِ لَا يَجُوزُ بِيَعُ الْأَوْصَافِ وَالْأَتْبَاعِ مَنْ الْحَيَوَانِ قَالَ أَمَّا بَيْعُ الْأَوْصَافِ فَكَبَيْعِ الْأَلْيَةِ مِنْ الشَّاةِ الْحَيَّةِ وَالْأَتْبَاعِ كَنِتَاجِ الْفَرَسِ وَاللَّبَنِ فِي الضَّرْعِ وَالثَّوْبِ الرَّقِيقِ يَصِفُ مَا تَحْتَهُ كَمَا يَصِفُ الرَّجُلُ سِلْعَتَهُ (وَالْوَصِيفُ) الْغُلَامُ وَالْجَمْعُ وُصَفَاءُ وَالْجَارِيَةُ وَصِيفَةٌ وَجَمْعُهَا وَصَائِفُ وَقَدْ أَوْصَفَ إذَا تَمَّ قَدُّهُ وَبَلَغَ أَوَانَ الْخِدْمَةِ وَاسْتَوْصَفَ كَذَلِكَ وَكِلَاهُمَا مَبْنِيٌّ لِلْفَاعِلِ فَإِنَّهُ يَصِفُ فِي (ش ف) .
