الذمة: لغة: العهد؛ لأن نقضه يوجب الذم، ومنهم من جعلها وصفًا فعرفها بأنها وصف يصير الشخص به أهلًا للإيجاب له وعليه، ومنهم من جعلها ذاتًا، فعرفها بأنها نفس لها عهد؛ فإن الإنسان يولد وله ذمة صالحة للوجوب له وعليه، عند جميع الفقهاء بخلاف سائر الحيوانات.
